Welcome to EZHRM. By accessing or using our website (ezhrm.in) and HR and payroll software services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.

1. Acceptance of Terms

By registering for or using EZHRM’s services, you confirm that you are at least 18 years old, have the authority to bind your organisation to these terms, and agree to comply with all applicable Indian laws and regulations.

2. Description of Services

EZHRM provides cloud-based HR and payroll software for Indian SMEs, including features such as payroll processing, attendance management, leave management, compliance (PF, ESI, TDS, PT), employee self-service, and AI-powered HR tools. Features available to you depend on your selected subscription plan.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use at [email protected].

4. Subscription and Payment

  • Subscriptions are billed in advance on a monthly or annual basis as per your chosen plan.
  • All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (GST).
  • Failure to pay may result in suspension or termination of your account.
  • Refunds are provided only as described in our Refund Policy.

5. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable law
  • Upload false, misleading, or fraudulent employee or payroll data
  • Attempt to gain unauthorised access to our systems or other users’ accounts
  • Reverse-engineer, copy, or redistribute our software or proprietary algorithms
  • Use our services to harass, defame, or harm any individual

6. Data Ownership and Responsibility

You retain ownership of all data you upload to EZHRM. You are solely responsible for the accuracy, legality, and completeness of employee data, payroll inputs, and statutory filings. EZHRM provides tools to assist with compliance but does not guarantee the accuracy of calculations based on incorrect data you provide.

7. Intellectual Property

All content, software, designs, and technology on the EZHRM platform are owned by or licensed to us and are protected by Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use our services during your subscription period.

8. Service Availability

We aim to maintain high uptime for our services but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance and will endeavour to provide advance notice where possible. We are not liable for losses arising from service unavailability.

9. Limitation of Liability

To the maximum extent permitted by Indian law, EZHRM’s liability for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Termination

You may cancel your subscription at any time through your account settings. We reserve the right to suspend or terminate your account for breach of these Terms, non-payment, or unlawful use, with or without notice. Upon termination, you may export your data within 30 days; thereafter we may delete it.

11. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. We encourage you to contact us first to resolve any concerns before initiating legal proceedings.

12. Changes to Terms

We may update these Terms from time to time. We will notify you by email or in-app notice for material changes. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
